Questions this sector asks first

The general position on each. What applies to you depends on where you live, where the work is done and who pays.

It is a form telling the US payer that you are not a US taxpayer and, where relevant, that you claim the US-UK treaty. Fees for work you do in the UK are not US-source income, so no US tax is withheld. The form is kept by the client and generally lasts three years.

Under the treaty, royalties paid to a UK resident are taxable only in the UK. The US payer needs a Form W-8BEN, or a W-8BEN-E for a company, to pay without withholding 30%. The income is then reported on your UK return, or the company's.

For most creative services supplied to a business customer in the US, no UK VAT is charged, because the supply is treated as made where the customer belongs. The sales still count in your records and on the VAT return. Work supplied to private individuals follows different rules.

A UK Self Assessment return and a US return, both on the same income. UK tax is claimed as a foreign tax credit, and under the totalisation agreement you pay UK National Insurance in place of US self-employment tax. UK accounts with a combined balance over $10,000 also need an FBAR each year.
