IRS Streamlined Filing Service UK: How It Works From Start to Finish

What a Streamlined service prepares for an American living in the UK: three years of returns, six years of FBARs and the Form 14653 certification, the eligibility tests, the documents gathered, each step to posting and what happens after the IRS receives the package.

IRS Streamlined filing service UK: an introduction

An IRS Streamlined filing service UK residents use prepares the full catch-up package that brings an American abroad back into US tax compliance. For most people in the UK, that means the Streamlined Foreign Offshore Procedures: three years of US returns, six years of FBARs and a signed Form 14653 certification. For eligible filers, the procedures waive the usual penalties. The service gathers your records, prepares every form, and helps you post the package and pay any tax and interest.

This article walks through the process from first contact to life after filing. For the rules in depth, read our guide to IRS Streamlined filing. Our Streamlined filing service page explains how we prepare the package from one file.

What an IRS Streamlined filing service UK-based Americans use is for

The Streamlined Filing Compliance Procedures are an IRS programme for people whose failure to file was not deliberate. The IRS describes them on its Streamlined filing compliance procedures page. They are designed for individuals and the estates of individuals. Therefore, a service built around them focuses on one goal: a complete, consistent submission that fits the IRS conditions.

What does a Streamlined service prepare?

A Streamlined service prepares three years of US tax returns, six years of FBARs and the non-wilful certification. It also prepares any information returns that belong with those years.

Three years of US tax returns

The IRS page for US taxpayers residing outside the United States sets the period. You file for each of the most recent three years whose return due date, or properly extended due date, has passed. If you never filed for a year, you file Form 1040 as a late original return. If you filed but left out income, you file an amended return on Form 1040-X. Consequently, many people in the UK file a mix of both.

Six years of FBARs

The FBAR is the Report of Foreign Bank and Financial Accounts. According to FinCEN's FBAR page, you file one when your foreign accounts together exceeded $10,000 at any time in the calendar year. Under the procedures, you file late FBARs for the most recent six years whose FBAR due date has passed. The legal duty comes from 31 USC 5314. Notably, the IRS removed its Delinquent FBAR Submission Procedures page in July 2026, so late FBARs on their own are not a penalty-free route.

The Form 14653 certification

Form 14653 is the certification by a US person residing outside the United States. In it, you certify that you are eligible, that your FBARs are filed and that your failures were non-wilful. You then explain why in a written statement of facts. Our article on the Form 14653 non-wilful certification covers that narrative in detail.

Information returns

Information returns are forms that report foreign assets or entities rather than tax. The IRS lists examples such as Forms 3520, 5471 and 8938. For instance, a UK company you own may need Form 5471, and larger account balances may need Form 8938. Therefore, a good IRS Streamlined filing service UK-based clients rely on checks for these forms in every year covered.

Who qualifies for the Streamlined Foreign Offshore Procedures?

You qualify if you meet the non-residency test and your failures were non-wilful. You also need a valid taxpayer identification number and no open IRS examination.

The non-residency test

For US citizens and green card holders, the test has two parts. You must have had no US abode, and you must have been physically outside the US for at least 330 full days. That must be true in at least one of the three most recent years covered. The IRS points to Publication 54 for the meaning of abode. People who are neither citizens nor green card holders instead must not have met the substantial presence test in one of those years.

Non-wilful conduct

Non-wilful conduct is conduct due to negligence, inadvertence or mistake, or a good-faith misunderstanding of the law. That is the IRS definition. In practice, it covers the American who never knew US filing continued after moving to Leeds. However, it does not cover someone who knew and chose to hide accounts. If you are worried that your conduct was wilful, the IRS points to the Criminal Investigation Voluntary Disclosure Practice instead.

General conditions

The general Streamlined page sets further limits. You are not eligible if the IRS has started a civil examination of your returns for any year. You are not eligible either if you are under criminal investigation. Furthermore, you need a valid taxpayer identification number. If you are not eligible for a Social Security number and have no ITIN, you can apply for an ITIN with the submission.

When the Domestic procedures apply instead

The Streamlined Domestic Offshore Procedures are the route for people who fail the non-residency test. The IRS page for US taxpayers residing in the United States requires original returns for each of the three years. You then amend them and file six years of late FBARs. Importantly, you also pay a miscellaneous offshore penalty of 5%. It is worked out on the highest total year-end balance of the foreign assets subject to the penalty. You sign Form 14654 rather than Form 14653. Our article on Streamlined Foreign versus Domestic compares the two.

What documents does an IRS Streamlined filing service need?

The service needs your history, your UK income records and statements for every foreign account. The more complete the records, the smoother the preparation.

Your history and identity

First, the service asks for your passport details and your Social Security number. Next, it asks when you moved to the UK and where you have lived since. Travel dates matter, because the 330-day count depends on them. Additionally, the service asks whether you ever filed a US return and whether anyone advised you about US tax.

UK income records

UK employers give a P60 to people working for them at the end of the tax year, as GOV.UK explains. Those forms, plus payslips, show your salary and UK tax paid. If you file UK Self Assessment returns, copies of those help too. However, the UK tax year does not match the US calendar year. Therefore, the service splits UK figures across the right US years.

Bank and investment statements

Every foreign account needs its highest balance for each FBAR year. That includes current accounts, savings, ISAs, investment platforms and accounts you can only sign on. Closed accounts count too, for the years they were open. In our experience, old accounts are the records most often missing. Consequently, the service may ask you to request archived statements from your bank early.

Pensions, property and companies

Workplace pensions, rental property and UK companies each bring extra questions. For example, a buy-to-let flat brings rental income, and a limited company may bring Form 5471. UK funds can bring separate reporting too. Therefore, a careful IRS Streamlined filing service UK-based Americans choose asks about these assets at the start, not after the returns are drafted.

What are the steps from first email to posting?

The process runs in five steps: eligibility, returns, FBARs, certification, then signing and payment. How long each step takes depends mostly on how quickly records arrive.

Step one: confirming eligibility

The first step is checking which route fits. The service counts your days outside the US, checks for a US abode and confirms you have no open examination. It also asks enough about your history to judge whether non-wilful conduct fits your facts. If the Foreign route does not fit, you hear that before any returns are prepared. In our view, every IRS Streamlined filing service UK-based clients use should start here.

Step two: preparing the three returns

Next come the three US returns. The foreign earned income exclusion is a relief that lets qualifying people exclude some foreign earnings, as the IRS foreign earned income exclusion page explains. The foreign tax credit is the alternative, claimed on Form 1116 for UK tax paid. In our experience, the better choice depends on your income and future plans. Therefore, we model both ways before settling the returns.

Step three: preparing the six FBARs

The FBARs are prepared from the statements gathered earlier. Each account's highest balance is converted into dollars for each year. Our article on the FBAR exchange rate explains which rate applies. Moreover, the FBAR figures are checked against the interest and dividends on the returns, so the two agree.

Step four: writing the certification

The certification comes last, once every figure is final. The IRS Streamlined FAQs ask for specific reasons, favourable and unfavourable facts, and the source of funds in each account. The statement is yours, so the service helps you set out your own facts clearly. As a result, the narrative matches the returns and FBARs exactly.

Step five: review, signing and payment

Finally, you review the whole package and sign. The returns and certification need your original signature. You then pay any tax and interest due, using one of the IRS payment options. The IRS asks you to include your taxpayer identification number with a cheque payment.

How is the Streamlined package submitted?

The tax returns go to the IRS on paper, while the FBARs are filed online with FinCEN. Both parts must be done for the submission to be complete.

Posting the returns to the IRS

The Foreign Offshore page says submissions are paper only, posted to a dedicated IRS address in Austin, Texas. Each return and information return carries 'Streamlined Foreign Offshore' in red at the top of the first page. The IRS calls that header critical, so an IRS Streamlined filing service UK-based clients rely on checks it on every page. In addition, the original signed Form 14653 goes in the package, with copies attached to each return. You do not attach it to the FBARs.

Filing the FBARs online

The FBARs are filed through FinCEN's BSA E-Filing System. On the cover page, you select 'Other' as the reason for filing late. In the explanation box, you enter 'Streamlined Filing Compliance Procedures', as the IRS page directs. As the IRS FBAR page confirms, the FBAR is never filed with your tax return.

Choosing the right three years

The covered years move as deadlines pass. A package prepared in spring may need a different set of years by the time it is posted. Practitioners sometimes differ on how extensions affect the window, so the cautious approach is to confirm the years at the date of posting. Consequently, a reliable IRS Streamlined filing service UK-based clients trust rechecks the period before the package leaves.

What happens after you file?

The IRS processes the returns, but it does not confirm receipt or send a closing letter. From then on, you file every year on time.

No acknowledgement and no closing letter

The general Streamlined page says the IRS will not acknowledge receipt of a submission. It also says the process does not end with a closing agreement. In practice, you see the returns processed through normal IRS channels, such as a notice or a refund. Therefore, keep proof of posting and your FBAR filing confirmations. A good IRS Streamlined filing service UK-based Americans use keeps copies of the full package as well.

The penalty position

For eligible filers, the Foreign Offshore page says you are not subject to failure-to-file, failure-to-pay, accuracy-related, information return or FBAR penalties. That protection continues if the returns are later examined. However, it falls away if an examination finds fraud or a wilful FBAR violation. Penalties already assessed for those years are not cancelled. Our article on FBAR penalties explains what the law allows otherwise.

Examination is still possible

Streamlined returns are not automatically audited. Nevertheless, the IRS says they can be selected for examination and checked against bank and adviser information. If you later find an error, the Streamlined Foreign Offshore FAQs explain how to send amended returns, provided you are not under examination.

Staying compliant afterwards

The IRS expects you to follow US law and normal filing rules in every later year. Americans abroad get an automatic two-month extension to 15 June to file, although interest runs from 15 April. The FBAR is due on 15 April, with an automatic extension to 15 October. Our article on the cost of Streamlined filing explains what affects the work involved.

A worked example of an IRS Streamlined filing service UK case

Consider a typical case. Megan is 38, born in Ohio and living in Bristol since she was 27. She has a UK salary, a workplace pension, an ISA and a joint savings account with her British partner. She has never filed a US return or an FBAR. This is an illustrative example, not a real client.

First, her days outside the US are counted, and she easily passes the 330-day test with no US abode. Next, her P60s and statements are gathered, including an old account she closed years ago. Then three Form 1040 returns are prepared, modelled both with the exclusion and with the foreign tax credit. After that, six FBARs list every account, and her certification explains that she believed US tax ended when she left.

What Megan's case shows

Megan's returns show little or no US tax, because her UK tax and the reliefs cover most of it. Even so, the package still matters, because her FBARs were missing for years. She posts the returns to Austin with the red header and files the FBARs online. She receives no closing letter. However, her first on-time return the following year shows the process is complete. In short, the IRS Streamlined filing service UK route turned years of missed filings into one tidy package.

How US UK Tax Experts can help

US UK Tax Experts prepares the three returns, six FBARs and the Form 14653 certification as one package, from one file. Because we also prepare UK returns, your US and UK figures agree. We check eligibility first, gather the records with you and model the reliefs both ways. Then we help you post the package and set up each later year. If the Domestic route fits better, we tell you before any work starts. The IRS Streamlined filing service UK-based clients get from us is built for exactly this kind of catch-up.

Conclusion

A Streamlined submission is a defined package: three returns, six FBARs and a signed certification. Most Americans in the UK use the Foreign Offshore route, which waives the usual penalties for eligible, non-wilful filers. The work is mostly in gathering records and keeping every figure consistent. After posting, there is no closing letter, so staying compliant each year is what completes the process. That is why an IRS Streamlined filing service UK-based Americans choose should also plan the years that follow.
